Child support custodial parent name change - Does it affect payments?
My ex-wife changed her name back to her maiden name roughly two years after our divorce and I had made payments through NYS child support collection unit to her maiden name. Years later I have a large balance of unpaid arrears under her maiden name, what can I do?
This sounds like the NYS child support collection unit was not notified of the name change and subsequent payment to the changed (maiden) name. It is generally the responsibility of the parties involved to notify governing agencies of name and address changes. Once these records have been corrected, the payments need to be verified as being paid by you to the custodial parent of the child. Hopefully you have records (checks, etc) from the payments over the years.
It's just a matter of working through the process of correcting the record. Start with a call to NYC child support agency. You may want an attorney to help you plow through the red tape, but it should be possible for you and your ex to correct the record. If she is not willing to help, then you may need an attorney to "coax" her cooperation. Good luck to you.
