Child Support Unreasonable
(Archdale, NC USA)
My child support seems unreasonable. I am looking at child support after a paternity test. I was told by my doctors 10 yrs ago I wouldn't be able to have children ever again. I went through several rounds of intense chemo and a Bone Marrow Transplant.
So 7 yrs later I ended up being in somewhat of a relationship with a woman and told her my life story. Well, she ended up pregnant. How who knows this wasn't supposed to happen.
I ended up keeping the child during the day while she went to work since I was always home any how. After some differences in opinions she decides to put the child in daycare. She cut off contact with me and next thing I know I am being served with child support papers.
So, yesterday I had my first court hearing. It seem to me the amounts the child support agent showed me was unreasonable. I am on a fixed income through social security ever since I went on disability which isn't much. I have a daughter 19, and a son 15 that lives with me full time and the mother has no contact with them.
I have other children as well from my marriage. I receive funds from Social Security for my son so I know that the child will be entitled to half of that which will be $400+. But the agent is asking for an additional amount as well as 33% of the daycare.
This is going to take about 1/3 of my household income. Can anyone help me with this or give me some advice on what to do.
Response: This case sounds like one that you surely would not be representing yourself in. Sometimes, you really don't need a lawyer - BUT, this is not one of them. Pay more now and get a lawyer - Or, you'll be paying more every month for a long time. And with child support, please remember that the goal is supporting the child's needs - but as equally as equitable with the other parent.
