FLORIDA DUI LAWS

Florida Dui laws as summarized by the Department of Highway Safety and Motor Vehicles states that a Florida DUI or Florida DWI is a charge proven by the impairment of a driver's normal faculties or a blood alcohol level ( BAC ) of .08 percent or above.

The fines and penalties for drunk driving conviction under Florida DUI laws are the same regardless of the manner in which the offense is proven and are normally as follows:

First Conviction: Not less than $500 or more than $1,000.
With Blood or breath Alcohol Level (BAL)or (BAC) of .15 or higher or minor in the vehicle: Fines from $1,000 to more than $2,000.

Second Conviction: Fines from $1,000 to more than $2,000.
With BAL of .15 or higher or minor in the vehicle: Fines increase to $2,000 to more than $4,000.

Third Conviction More than 10 years from second: Fines are not less than $2,000 and not more than $5,000.
With BAL of .15 or higher or minor in the vehicle: Fines are not less than $4,000.

Fourth or Subsequent Conviction: Fines are not less than $2,000.

Community Service: Mandatory 50 hours or more of community service may be ordered. An additional fine of $10 for each hour of community service not served may also be required.

Probation: For a first conviction, a total period of probation and incarceration may not exceed 1 year and increase with subsequent DUI offenses. Unless the family of the defendant has no other transportation, a drunk driver in Florida will likely have their car impounded for at least 10 days.

Florida DUI laws may impose a felony Conviction for repeat offenders or drunk driving related auto accidents and/or injuries.

Manslaughter and Vehicular Homicide convictions under Florida DUI laws may impose fines up to $10,000 and imprisonment for up to 15 years.

Florida does not make provisions for persons disqualified from operating a commercial motor vehicle to obtain a hardship license to operate a commercial motor vehicle.
